I know the statement I am about to make is comical at best, but I have actually come to the conclusion that Associate Justice Anthony Kennedy is the de facto King of the United States. And maybe the only Justice who puts the constitution over the party line.
Now I disagree with him maybe 8 out of 10 times. However, I envision the job of the Supreme Court to interpret the Constitution, not reinforce ideological disputes.
He is the only voice who you can usually expect to vote what he believes to be constitutional and not the party line.
Now I’m no constitutional lawyer, or Supreme Court scholar but I can figure out a sure thing. And 9 times out of 10 if I was arguing in front of the Supreme Court I would only care to persuade Justice Kennedy, for he is the only check and balance we have.
Like I said, I can handle a decision that goes against my ideological view. What I can’t accept is a decision that is not a constitutional interpretation but an unbending partisan stance. Whether I agree with the view or not, the constitution is not a partisan toy.
Unfortunately, I feel the votes of eight of the nine Justices are predetermined. And this leaves Justice Kennedy as the only real check and balance for the Judicial Branch.
